29 CFR  1926.453(b)(2)(v):A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:  a)  3300 Central ave, Billings, MT:  On or about October 8, 2022, and at times prior, employees were exposed to catapult and subsequent fall hazards while operating an Aerial Lift at heights of approximately 33 feet to the ground below while not wearing fall protection or being tied off to the basket of the Aerial Lift.

29 CFR  1926.453(b)(2)(iv):Employee(s) working in an aerial lift were sitting or climbing on the edge of the basket:   a) 3300 Central Ave, Billings, MT:  On or about October 8, 2022, and at times prior, employees were exposed to catapult and subsequent fall hazards while installing metal flashing on a building and accessing the roof by climbing on and over the Aerial Lift basket railing at heights of approximately 33 feet to the ground below.

29 CFR  1926.760(a)(1):Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level shall be protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems.  a) 3300 Central Ave, Billings, MT:  On or about October 8, 2022, and at times prior, employees were exposed to fall hazards of approximately 33 feet to the ground below while installing metal flashing on a metal fabricated storage building.
