29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about October 12, 2022, an employee was installing shingles on a residential home under construction using a pneumatic nail gun without eye protection, exposing the employee to the hazard of being struck-by flying objects or debris.  The Sergio Bautista was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1) , which was contained in OSHA inspection number 1512996, citation number 1, item number 1 and was affirmed as a final order on March 15, 2021, with respect to a workplace located at 11302 Carmen Heights, San Antonio, TX 78201.

29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction 6 feet (1.8 m), or more above lower levels were not protected from falling by the use of guardrail systems, safety net systems or personal fall arrest systems nor was an alternative fall protection plan which meets the requirements of 1926.502(k) developed and implemented.  On or about October 12, 2022, employees were securing shingles to the roof of a residential home under construction without the use of fall protection, exposing the employees to the hazard of falling approximately 35-feet to the ground below.  The Sergio Bautista was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1375036, citation number 1, item number 1 and was affirmed as a final order on March 1, 2019, with respect to a workplace located at 802 Kingston Dr., Cedar Park, TX 78613.  The Sergio Bautista was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1512996, citation number 2, item number 1a and was affirmed as a final order on March 15, 2021, with respect to a workplace located at 11302 Carmen Heights, San Antonio, TX 78201.
