29 CFR  1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet or more above a lower level was protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  a) On October 13, 2022 and at times prior employees were exposed to fall hazards up to 8.5 feet to the ground below while standing on the top of a fuel delivery "tank wagon" truck  and a fuel storage trailer while transferring fuel from the storage trailer into the delivery truck. 29 CFR 1910.106(f)(3)(iv)(a): Bonding facilities for protection against static sparks during the loading of tank vehicles through open domes were not provided:  a) On October 13, 2022, employees transloaded diesel fuel between a storage trailer and two delivery trucks without grounding or bonding any of the vehicles together.  A mixture of red and green diesel fuel was pumped out of the top of a 5000- gallon storage trailer using the pump of a delivery truck into the rear, open dome of another delivery truck.    Note) Abatement certification and documentation are required for this item.

Employees transloaded a mixture of red and green diesel into the top rear dome of a 3600- gallon capacity fuel truck that was not equipped with bonding connection hardware. 29 CFR 1910.106(f)(3)(iv)(e): Filling through open domes into the tanks of tank vehicles or tank cars, that contain vapor-air mixtures within the flammable range or where the liquid being filled can form such a mixture, was not done by means of a downspout which extends near the bottom of the tank:  a) On October 13, 2022 the delivery hose used by an employee to top load diesel fuel into the rear dome of a 3600 gallon capacity delivery truck tank did not extend to the bottom of the tank, creating a potential flammable vapor atmosphere.
