29 CFR  1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a) Gross Construction, Inc. at 1005 Westland Avenue, Volga, SD 57071: On or about and at times prior to October 19, 2022, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. An employee was conducting framing and sheathing operations on a residential property without the use of a fall protection system on site and a lack of training.  This condition exposed employees to fall hazards of greater than six feet.

29 CFR  1926.501(b)(13): Employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):   (a)Gross Construction, Inc. at 1005 Westland Avenue, Volga, SD 57071: On or about and at times prior to October 19, 2022, the employer did not ensure that an employee was protected from falls, in that employee was conducting roof sheathing operations on a residential property without the use of a fall protection system. This condition exposed the employee to fall hazards greater than six feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards:  (a)Gross Construction, Inc. at 1005 Westland Avenue, Volga, SD 57071: On or about and at times prior to October 19, 2022, the employer did not ensure that the employee was properly trained on the use of fall protection systems prior to being exposed to the fall hazards while working on a residential roof.  This condition exposed the employee to fall hazards greater than six feet.
