29 CFR 1910.1030(c)(1)(i): The employer having employee(s) with occupational exposure did not establish a written Exposure Control Plan designed to eliminate or minimize employee exposure.  On or about 10/18/2022 at 107 East Broadway 3rd Floor, New York, NY 10002, acupuncturists performing acupuncture procedures using Mac 36G X 1.5-inch needles were exposed to blood borne pathogens without being provided a written exposure control plan by their employer.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19

29 CFR 1910.1030(g)(2)(vii)(A): The bloodborne pathogens training program did not contain an accessible copy of the regulatory text of this standard and an explanation of its contents:  On or about 10/18/2022 at 107 East Broadway 3rd Floor, New York, NY 10002, acupuncturists performing acupuncture procedures using Mac 36G X 1.5-inch needles had reasonably anticipated exposure to blood borne pathogens without being provided a training program containing a copy of the regulatory text of the bloodborne pathogen standard and an explanation of its contents.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19
