29 CFR  1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.   Workers were exposed to struck-by hazards at a worksite at 3209 S Rangeline Rd, Joplin, MO 64804. This was last demonstrated on or about October 10, 2022, when workers were permitted to operate JLG rough-terrain powered industrial truck (Model# 8042) without having been trained, evaluated, and certified to use the equipment while framing a commercial building.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net systems, or personal fall arrest system, nor were an employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   Workers were exposed to fall hazards at a worksite at 3209 S Rangeline Rd, Joplin, MO 64804. This was last demonstrated on or about October 10, 2022, when workers were engaged in framing activities of a commercial building. Workers placing trusses were exposed to fall hazards ranging from 13.4 to 13.8 feet from the eve of the truss line to the ground below. No guard rails, safety net system(s), or personal fall arrest system(s) were utilized to prevent falls.

29 CFR  1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper-level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.   Workers were exposed to fall hazards at a worksite at 3209 S Rangeline Rd, Joplin, MO 64804. This was last demonstrated on or about  October 10, 2022, when workers were engaged in roofing activities. Workers framing a commercial building were exposed to fall hazards of 13.4 to 13.8 feet from the trusses to the ground below. Workers were using an extension ladder (Little Giant Multi) to gain access to the roof area and it did not extend at least feet above the landing that was being accessed.
