29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. On or about October 26, 2022, on the south side of the construction site, the employer did not provide a scaffold ladder where employees could access and egress the tubular welded frame scaffold safely exposing them to fall hazards.

On or about October 26, 2022, on the south side of the construction site, employees working from a tubular welded frame scaffold that was not fully planked on all working levels were exposed to falling hazards.

The employees were exposed to a fall hazard of 13-feet to the ground below.

For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall.
