On or about October 26, 2022, and at times prior thereto, employees used an aerial lift to attach a moisture barrier on the exterior of the apartment complex under construction without being trained and certified on the equipment.

29 CFR  1926.453(b)(2)(v): Employer failed to ensure a lanyard attached to the boom or basket when working from an aerial lift.  On or about October 26, 2022, and at times prior thereto, employees used an aerial lift to attach a moisture barrier on the exterior of an apartment complex under construction without being attached to the boom basket, exposing the employees to the hazard of falling up to approximately 35 feet to the ground below.

29 CFR  1926.501(b)(13): Employee(s) engaged in residential construction 6 feet (1.8 m) or more above lower levels were not protected from falling by the use of guardrail systems, safety net systems or personal fall arrest systems nor was an alternative fall protection plan which meets the requirements of 1926.502(k) developed and implemented:   On or about October 26, 2022, and at times prior thereto, employees were framing an apartment complex under construction without the use of a fall protection system, exposing the employees to the hazard of falling approximately 35-feet to the ground below.
