29 CFR 1910.28(b)(3)(i): The employer did not ensure that each employee was protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following methods listed in 29 CFR 1910.28(b)(3)(i)(A)-(D): a) Building 19/20, Roof - Employees were not protected from falling while working and walking around an uncovered hole in the roof which measured approximately 53 1/2 inches wide x 74 inches long and 33 feet above a lower level, on or about November 2, 2022. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.30(c)(3): The employer did not retrain employees when inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicated that the employee no longer had the requisite understanding or skill necessary to use equipment or perform the job safely: a) Building 19/20, Roof - Employees were not retrained while working and walking around an uncovered hole in the roof which measured approximately 53 1/2 inches wide x 74 inches long and 33 feet above a lower level, while using on personal fall protection system not properly inspected, operational, or maintained, or about November 2, 2022. b) Building 19/20, Roof - Employees were not retrained while using a 6-foot single leg polyester shock absorbing lanyard as part of a personal fall protection system and tied off to the rail of a catwalk with the snaphook connected back to its webbing, on or about November 2, 2022. c) Building 19/20, Roof - Employees not retrained while using an 11-foot self retracting lifeline as part of a personal fall protection system and tied off to the rail of a catwalk with the snaphook connected back to its webbing, on or about November 2, 2022. d) Building 19/20, Roof - Employees were not retrained while using a 20-foot self-retracting lifelines as part of a personal fall protection system and tied off to the rail of a catwalk with the snaphook connected back to its wire rope, on or about November 2, 2022.
