29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. On or about November 8, 2022, St. Louis Powersports, located at 1729 Chase Drive in Fenton, Missouri, did not remove from service a powered industrial truck in need of repair, defective, or in any way unsafe: Propane-powered Toyota forklift, Model 8FGCU30, Serial 10958. The forklift was defective at the time of the inspection. The seat had been replaced with a mower seat, with no seatbelt. The brake pedal was missing a brake pad, and bare metal was exposed. The propane tank was improperly installed, with the LPG locator/index pin not engaged.
