29 CFR 1910.1450(e)(1): Where hazardous chemicals were used in the workplace, the employer did not develop and carry out the provisions of a written Chemical Hygiene Plan which was capable of protecting employees from health hazards associated with hazardous chemicals. a.) Caring Healthcare Network, LLC, 18 North Front Street, Philipsburg, PA 16866 - On or about November 9, 2022, hazardous chemicals including, but not limited to, methanol, acetonitrile, ethyl alcohol, and formic acid were used by employees in the laboratory. The employer's Biosafety Policy contained elements of a Chemical Hygiene Plan, however it is deficient in areas including, but not limited to: 1.) Providing criteria that the employer would use to determine and implement control measures to reduce employee exposure to hazardous chemicals including engineering controls, the use of personal protective equipment and hygiene practices. 2.) Providing requirements to ensure that fume hoods and other protective equipment are functioning properly with specific measures that shall be taken to ensure proper and adequate performance of such equipment. 3.) Providing provisions for employee information and training. 4.) Providing the circumstances under which a particular laboratory operation, procedure or activity shall require prior approval from the employer or the employer's designee before implementation. 5.) Providing provisions for medical consultation and medical examinations for employees who work with hazardous chemicals in accordance with 29 CFR 1910.1450(g). 6.) Providing provisions for additional employee protection for work with particularly hazardous substances which include "select carcinogens," reproductive toxins, and substances which have a high degree of acute toxicity. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

The employer did not conduct workplace-specific training or provide employees with information regarding the hazards associated with the chemicals used in the laboratory. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
