29 CFR  1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) On or about 11/9/2022 at water service project located at 2003 Ridge Road, West Seneca,  New York; employees were in an excavation to install a new water line. The excavation was approximately 6 to 7 feet deep with walls not adequately sloped and not properly protected from cave-ins. Employees had not been trained in soil classification nor how select cave-in protection systems based on soil classification and conditions.  a) On or about 11/9/2022 at water service project located at 2003 Ridge Road, West Seneca,  New York; employees were working roadside in and around an excavation to install a new water line. The employees were excavating roadside and in the right of way of Ridge Road east bound lane. Employees had not been trained in work zone set up including, but not limited to, early warning, transition areas, redirection of traffic from normal path when encroaching on the lane of travel, and devices and methods to control traffic.  ABATEMENT CERTIFICATION REQUIRED

The employees were excavating roadside and in the right of way of Ridge Road east bound lane. The employer did not provide advance warning to road users that road work is taking place or what actions the road user must take to drive through the work zone, thereby exposing employees in the work zone to struck-by hazards.
