29 CFR 1918.81(k): The employer shall require that employees stay clear of the area beneath overhead drafts or descending lifting gear.  A) Delaware River Stevedores, Balzano Marine Terminal- Camden, NJ: Employees at this facility were exposed to struck-by and caught in/between hazards during cargo handling operations when the plate was being moved in the hold while the employee was still within the area of operations when plate dropped and struck the employee. Condition noted on or about November 9, 2022.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  (a) Employer did not report hospitalization within the 24 hours requirement of a work-related incident. An employee suffered laceration and fractures foot and was hospitalized on or about 11/09/2022.
