OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazards of fall and being struck by and/or caught in between the load and the backrest of the forks of a forklift truck. Site: 498 Columbia St in Brooklyn, New York. a) On or about 11/24/2022, an employee was exposed to the hazards of fall and being struck by and/or caught in between the load and the backrest of the forks of a forklift truck, while standing on the elevated forks raised to the level of the truck bed during the unloading of a tractor-trailer truck.

29 CFR 1910.178(o)(1): The employer did not ensure that only stable or safely arranged loads were handled: Site: 498 Columbia St in Brooklyn, New York. a) On or about 11/24/2022, an employee was handling a pallet of doors, which could not be safely arranged and loaded onto the forks of a forklift truck. The pallet fell towards the employee and pinned him against the backrest of the forks during the unloading process.
