29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d):   29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.     On or about November 30, 2022, employees were exposed to an ejection hazard while using a rough terrain forklift with an attached basket to elevate employees for access and egress to the roof.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems:  On or about November 30, 2022, and at times prior thereto, employees were exposed to a fall hazard greater than 15 feet to the ground below while installing metal decking without using a personal fall arrest system.
