29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  On or about December 01, 2022, The employer did not ensure that  employees working inside an excavation at approximately 5'7 feet  in depth were  using head protection. Employees were  exposed to struck- hazards from debris and other head injuries.  Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  On or about December 01, 2022, employees inside the trench did not have safe access to trench, exposing the employee to hazards associated with not having safe access to trench and the employer did not ensure safe access was available for use. The trench was approximately 5'7 feet in depth.   No abatement certification or documentation is required for this item.

29 CFR  1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift:   On or about December 01, 2022, Employees were exposed to the cave-in hazards associated with working in and around the excavation that had not been inspected by a competent person.     Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR  1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  On or about December 01, 2022, Employees working inside a trench in approximately 5'7 feet deep  were not protected by a protective system, therefore exposing employee to hazards associated with cave-in. Employer did not ensure cave-in protection was utilized.
