29 CFR 1926.1408(b)(1):29 CFR 1926.1408(b)(1): The employer did not conduct a planning meeting with the operator and the other workers who will be in the area of the equipment or load to review the location of the power line(s), and the steps that will be implemented to prevent encroachment/electrocution. a) WT Excavating, LLC, 13111 Huron St, WESTMINSTER, CO 80234: On and around December 8, 2022, and at times prior, employees were exposed to electrocution hazards when the employer assigned workers to conduct work near an energized power line without initially conducting a planning meeting to implement steps to prevent encroachment on the line while working. The employer posted signs warning of the overhead power lines but did conduct any further planning to ensure workers would encroach on the power lines.

29 CFR 1926.1408(d)(1):Part(s) of equipment, load line, or load (including rigging and lifting accessories) were allowed below an energized power line when the exceptions to paragraph (d)(2) did not apply: a) WT Excavating, LLC, 13111 Huron St, WESTMINSTER, CO 80234: On and around December 8, 2022, and at times prior, employees were exposed to electrocution hazards when the employer did not ensure that the extensible boom of the excavator used to dig an excavation was more than 20 feet from the nearby overhead powerline at all time. The boom was at least able to be within 5-6 feet of the energized line without a designated spotter.
