OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about December 8, 2022, and at times there to, employees were exposed to struck-by injuries from flying shards of polyvinyl chloride piping which was used to transport compressed air. ASME B31.3-2016, Process Piping A323.4.2 Specific Requirements, (a) Thermoplastics, (3) PVC and CPVC shall not be used in compressed air or other compressed gas service.

29 CFR 1910.1025(h)(1): All surfaces were not maintained as free as practicable of accumulations of lead: On or about December 8, 2023, and at times thereto, employees engaged in automotive mechanic activities and utilized different tools and equipment. Work surfaces were not regularly cleaned to prevent accumulation of lead. Monitoring was conducted to ascertain lead presence and exposure in the following were exposed to lead dust in locations, including, but not limited to the following: a. WIPE #4 - black toolbox north of Bay 5 - 469.108 ug/ft2; b. WIPE #5 - black toolbox north of Bay 1 - 51.144 ug/ft2; c. WIPE #6 - tire balancer in storage area - 58.308 ug/ft2; and, d. WIPE #2 - EE2 hands - 210.651 ug/ft2.
