29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or electrical shock and burns, were not protected by protective helmets. On or about December 15, 2022, and at times prior thereto, employees were framing a new hotel under construction without the use of hard hats while work was occurring directly above, exposing the employees to the hazard of being struck by falling debris, tools, and materials.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids, or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. 29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms where the entire platform was not attached to the fork. On or about December 15, 2022, and at times prior thereto, employees used an unapproved personnel platform on a rough terrain forklift to attach boards to the exterior of the hotel under construction without the platform being secured to the forks, exposing employees to an all a hazard.
