29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use. On or about December 21, 2022, and at times prior thereto, employees changing out chemicals within the DI Plant area were required to wear a respirator, exposing employees to an undue physiological burden. The employer did not implement a written respiratory protection program to include but not limited to the following: a) Ensuring employees were medically cleared to wear a respirator. b) Ensuring employees were fit tested on respirator worn. c) Provide listing of approved respirators by brand and model. d) Training of employees in the respiratory hazards to which they are potentially exposed. e) Training of employees in the proper use of respirators, including putting on and removing them, any limitations on their use, and their maintenance.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use. On or about December 21, 2022, and at times prior thereto, employees changing out chemicals in the DI Plant area did not have access to an emergency eyewash station, exposing employees to health hazards.

On or about December 21, 2022, and at time prior thereto, the employer did not provide effective information and training on hazardous chemicals in their work area prior to requiring employees to perform operations with the chemicals, such as but not limited to, Caustic Soda 20-54% and Hydrochloric Acid, exposing employees to inhalation and absorption hazards.
