A masonry crew was working on the fourth tier of a four-tier scaffold approximately 22 feet above ground level and on the roof of the home with one laborer working at ground level and another mason ascending/descending the scaffold for roof access. The employees were positioned beneath materials and equipment that was on the scaffold without head protection. The following condition exposed employees to struck-by hazards.

When the falling objects are too large, heavy or massive to be contained or deflected by any of the above-listed measures, the employer shall place such potential falling objects away from the edge of the surface from which they could fall and shall secure those materials as necessary to prevent their falling.  a) Shamblin Masonry and Restoration, LLC located at 1844 Barrington Road, Upper Arlington, OH 43221:  On and preceding January 6, 2023, the employer did not ensure that toeboards were installed on the working levels of scaffolding that was being used as a work platform and as the primary means of access to the roof of the house. A masonry crew was working on the fourth tier of a four-tier scaffold approximately 22 feet above ground level without toeboards installed to prevent tools and materials from falling to the lower level as other employees stood on ground level and ascended/descended the scaffold for roof access. The following condition exposed employees to struck-by hazards.

The top guy, tie or brace of completed scaffolds shall be placed no further than the 4:1 height from the top. Such guys, ties and braces shall be installed at each end of the scaffold and at horizontal intervals not to exceed 30 feet (9.1 m) (measured from one end [not both] towards the other).   a) Shamblin Masonry and Restoration, LLC located at 1844 Barrington Road, Upper Arlington, OH 43221:  On and preceding January 6, 2023,  the employer did not ensure that guys, ties and braces were installed according to the scaffold manufacturer's recommendations or at the closest horizontal member to the 4:1 height.  A 4-tier scaffold measuring 5 feet wide and more than 22 feet in height at the top tier with decking and 28 feet at the top was not secured to the structure of the building while employees performed masonry work on the top tier.  With the scaffold not being secured at a 4:1 height, employees were exposed to falls and struck-by hazards in the event of a scaffolding collapse.

A masonry crew member was working on a chimney located near the southwest edge of the ridge of the roof.  The eave of the roof was 20 feet 3 inches above ground level with a slope of approximately 9/12 without any form of fall protection being utilized. The following condition exposed employees to fall hazards exceeding 20 feet.
