29 CFR  1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  At 863 Park Ridge Lane, Roswell, GA 30076 at the Roswell Creek Apartments, building #841 on or about January 5, 2023 and at times prior, the employer exposed employees to fall hazards, in that fall protection was not provided to employees while removing and installing shingles on the roof of building #841 when working at height measured greater than 20 feet 3 inches.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  At 863 Park Ridge Lane, Roswell, GA 30076 at the Roswell Creek Apartments, building #841 on or about January 5, 2023 and at times prior, the employer exposed employees to fall hazards, in that the extension ladder accessing the roof extended less than 3 feet (.9 m) above the level of the roof surface being accessed by employees while removing and installing shingles on the roof of building #841 with ladder side rails measured at approximately 1 foot 0 inches the upper landing surface being accessed.
