29 CFR 1926.100(a): Employee(s) working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  On January 6, 2023, at the job site located at 730 E. Magnolia in Salina, KS, employees engaged in trenching and excavation activities were exposed to struck-by hazards from rocks, dirt, and other material  in the area.  The employees were working inside trench that was approximately 9 feet deep.  The employees were not provided with proper head protection.

29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On January 6th, 2023 at the job site located at 730 E. Magnolia in Salina, KS, employee(s) using weld on epoxy to attach PVC piping to each other were  exposed to eye injury hazards.  Employees were not wearing proper PPE in the form of gloves, eye protection/face protection as identified in paragraph 8.2 Exposure Controls within the SDS.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  The employer is failing to protect employees from struck-by and collapse hazards associated with trench work. This was most recently documented at the residential construction site located at 730 E. Magnolia in Salina, KS, on January 06, 2023, when the employer did not ensure employees were protected by benching, sloping, shoring, shielding, or other adequate cave-in protection while working in a trench that was approximately 9 feet deep. The trench collapsed, resulting in the engulfment of two employees.
