29 CFR  1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.   At 4801 Baker Grove Rd., Acworth, GA 30101 at The Bauer Apartments, building #1100 on or about January 11, 2023 and at times prior, the employer exposed employees to fall hazards, in that fall protection was not provided to employees while removing and installing shingles on the roof of building #1100 from a height of over 17 feet.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  At 4801 Baker Grove Rd., Acworth, GA 30101 at The Bauer Apartments, building #1100 on or about January 11, 2023 and at times prior, the employer exposed employees to fall hazards, in that the extension ladder accessing the roof extended less than 3 feet (.9 m) above the level of the roof surface being accessed by employees while removing and installing shingles on the roof of building #1100.  Ladder side rail was measured to extend approximately 1 foot 4 inches above the upper landing surface being accessed.
