29 CFR  1926.501(b)(1): Employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  (a)Reynolds Construction Management Services, Inc. at 7400 East Oak Grove Trail, Sioux Falls, SD 57110:  On or about and at times prior to January 12, 2023, the controlling employer did not ensure that each employee was protected from falls from heights, in that subcontracted employees were conducting framing operations on a commercial property with no protective system in place.  This condition exposed the employees to a fall hazard greater than six feet.

29 CFR  1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a)Reynolds Construction Management Services, Inc. at 7400 East Oak Grove Trail, Sioux Falls, SD 57110: On or about and at times prior to January 12, 2023, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person. Subcontracted employees were conducting framing operations on a commercial property without the use of a fall protection system in place and improper use of ladders.  This condition exposed employees to fall hazards of greater than six feet.
