OSH ACT of 1970 Section (5)(a)(1)  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees  (a) 935 Hill Church Road, Hummelstown, Pennsylvania - The employer did not maintain worksite conditions that were fully compliant with the generally accepted work proacties, on or about January 16, 2023.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR  1910.132(a): Protective equipment was not used when necessary, whenever hazards capable of causing injury and impairment were encountered:  (a) 935 Hill Church Road, Hummelstown, Pennsylvania - Employees used chain saws on the ground to cut tree limbs and other tree sections into smaller sizes to fit into the chipper.  The employer did not require employees to wear chainsaw-resistant leg protection (chaps), and the employees did not wear chainsaw-resistant leg protection (chaps), exposing the employees to the hazard of contact with the cutters and moving chains of the saws, on or about January 16, 2023.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and shall state that employees and their representatives were informed of this abatement

29 CFR  1910.1200(e)(1): The employer did not develop, implement, and maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a) 935 Hill Church Road, Hummelstown, Pennsylvania - Employees had exposure to hazardous chemicals, including, but not limited to, gasoline, (which constitutes a Category 2 flammable liquid; a chemical which produces carbon monoxide, a chemical asphyxiant; and a chemical which can have damaging effects on the kidneys and liver).  The employer did not develop, implement, and maintain a hazard communication program, on or about January 16, 2023.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and shall state that employees and their representatives were informed of this abatement.
