29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: On or about January 24, 2023, employees in the grinding area were exposed to noise levels exceeding 90 dBA on 90 dB threshold and a monitoring program was not developed. a. On January 24, 2023, employee was using a pneumatic handheld sander to sand metal frames inside a booth with metal walls was exposed to 93.51 dBA on 80 dB threshold, as an 8 hour time weighed average. The employee was sampled for 470 minutes, the remaining 10 minutes was calculated as 0 (zero) exposure time. b. On January 24, 2023, employee was using a pneumatic handheld sander to sand metal frames inside a booth with metal walls was exposed to 96.49 dBA on 80 dB threshold, as an 8 hour time weighed average. The employee was sampled for 459 minutes and the remaining 21 minutes was calculated as 0 (zero) exposure time.

29 CFR 1910.1200(h)(1):Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: On or about January 24, 2023, employees welding and sanding mild steel did not have training on the health effects of metals including respiratory irritation, skin irritation, eye irritation and welding fume fever.
