OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards while operating automotive lifts: a. Denver Auto Body Inc., On January 24 2023, the employer did not ensure that employees were safe from crushing and struck-by hazards while using the 10,000 pound capacity Wheeltronic LTD auto lift, Model 42010VS in that the lifting pads on the swing arms did not contact the frame of the vehicle at the pinch welds specified for lifting. A vehicle was raised with unrated, unlisted and uncertified wooden blocks placed on the lifting pads of the swing arms. Employees are exposed to struck by and crushing hazards.

29 CFR 1910.334(a)(2)(i): Portable cord and plug connected equipment and flexible cord sets (extension cords) were not visually inspected before use on any shift for external defects such as loose parts, deformed and missing pins, or damage to outer jacket or insulation and for evidence for possible internal damage such as pinched or crushed outer jacket: a. Denver Auto Body Inc., on January 24, 2023, the employer did not ensure the flexible power cords used were inspected and outer insulation jacket were free of any external defects. This condition exposed the employees to electrical shock, burns and fire hazards.

Denver Auto Body Inc., on January 24, 2023, the employer did not ensure secondary containers of chemicals were labeled correctly with the chemical content of the container and the hazard warnings of the chemical contained therein. There were two unlabeled containers including spray bottles, buckets and plastic containers in the service shop. This condition exposed employees to skin, eye and respiratory hazards.
