Employee in the trench was also not wearing ha hard hat.

29 CFR  1926.651(h)(1):Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation:  Worksite located at 5353 NW 64th St., Kansas City, Missouri- Employees were exposed to cave-in hazards while working in an unprotected trench that was not protected from cave-ins by the use of proper shoring, sloping, or shielding. The trench was also filling with water due to the water main breakage which causes the soil to be even less cohesive, employees could slip and become stuck in the mud. The trench walls sloughed off during the inspection which could entrap or strike an employee in the trench due to soil which saturated with water.
