29 CFR 1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system: On January 24, 2023, employees of Kalahari Construction, LLC were installing the roof structure of a commercial building located at 1610 Woodstone Drive, Saint Peters, Missouri. The roof of the building was approximately 32 feet above ground level with a pitch less than 4:12. Employees working on the roof were exposed to fall hazards by not utilizing guardrail systems, a safety net system, or a personal fall arrest system.

Note: The requirements applicable to construction work under this paragraph are identical to those set forth at 1910.178(l) of this chapter: 29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not conducted at least once every three years: On January 24, 2023, employees of Kalahari Construction, LLC were installing the roof structure of a commercial building located at 1610 Woodstone Drive, Saint Peters, Missouri. A JCB telehandler Model # 510.56, Serial # JCB5CG7GVH2672997, was used to lift a NTM SSQII Roof Panel Machine into place on the roof of the structure. The employer did not ensure that employee(s) operating the powered industrial truck were evaluated at least once every three years.
