29 CFR  1910.253(b)(4)(i): Oxygen cylinders shall not be stored near highly combustible material, especially oil and grease; or near reserve stocks of carbide and acetylene or other fuel-gas cylinders, or near any other substance likely to cause or accelerate fire; or in an acetylene generator compartment:  a) Outside welding area of TowYo L.L.C: On or about January 31, 2023, the employer exposed employees to combustion hazards in that oxygen cylinders were stored outdoors within 1-foot of acetylene and propane cylinders.  b) Outside of welding area of TowYo L.L.C: On or about January 31, 2023, the employer exposed employees to combustion hazards in that oxygen cylinders were not separated from fuel- gas cylinders by a minimum distance of 20 feet, by at least 5 feet within a noncombustible barrier.

29 CFR  1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:   a) Facility: On or about January 31, 2023 the employer exposed employees to safety and health hazards, in that there was not an established hazard communication program for employees that used hazardous chemicals.
