OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to injuries caused by the operation and collision of powered industrial trucks and the failure to wear seat belts.  a) On or about February 1, 2023, the employer did not ensure the Toyota Forklift Model 8FGCU15, Serial Number 21213 was equipped with a seat belt assembly.  b) On or about February 1, 2023, the employer did not ensure the Caterpillar Forklift Model C5001, Serial Number AT9010143 was equipped with a seat belt assembly.

29 CFR  1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition.  a) On or about February 1, 2023, the employer failed to ensure industrial trucks were that were in need of repair were taken out of service.  Multiple forklifts were identified with broken seatbelt assemblies and/or defective horns.

29 CFR  1910.178(q)(7):Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.  a) On or about February 1, 2023, the employer failed to ensure industrial trucks were examined daily before being placed in service to determine if there were any defects that would affect the safe operation.
