29 CFR  1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level was not protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold.   a) Third buck of scaffold at back of building; On or about February 8, 2023 and times prior the employer exposed employees to 18 foot fall hazards in that the employer allowed employees to work from the third buck of a scaffold without fall protection such as but not limited to guardrail systems, personal fall arrest systems, or safety net systems.

29 CFR  1926.451(e)(1):When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface were not used. Crossbraces shall not be used as a means of access.  a) Back of building; On or about February 8, 2023 and times prior the employer exposed employees to fall hazards in that the employer did not install adequate means of access to higher levels of the scaffold for employees.

The scaffolding poles were installed directly on mud sills, with no base plates present.

29 CFR  1926.451(b)(1):Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii):  a) Third buck of scaffold at back of building; On or about February 8, 2023 and times prior the employer exposed employees to fall hazards in that the employees were allowed to work from the top level of a three buck high scaffold which was not fully planked.
