29 CFR 1910.146(c)(8): When an employer (host employer) arranges to have employees of another employer (contractor) perform work that involves permit space entry, the host employer did not comply with the requirements specified in section 1910.146(c)(8)(i) through (v): a) 30548 Thorogoods Road Dagsboro, DE: On or about February 1, 2023, the compliance officer determined that the employer had not inform his contracted employer of the space being worked in is a confine space which is required to be evaluated. The employer did not ensure atmospheric testing was performed prior to allowing employees to enter into this confined space [e.g. sand bin] to perform cutting and welding with a potential for an atmospheric hazard(s), including oxygen deficiency and engulfment hazard.

29 CFR 1910.146(g)(1): The employer did not provide training so that all employees whose work was regulated by 29 CFR 1910.146 (permit required confined spaces) acquired the understanding, knowledge, and skills necessary for the safe performance of the duties assigned under 29 CFR 1910.146: a) 30548 Thorogoods Road Dagsboro, DE: On or about February 1, 2023, the compliance officer observed that the host employer did not ensure that all employees with the responsibility of entering the confine space received training to ensure they had acquired the necessary understanding, knowledge, and skills to perform their duties safely.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: a) 30548 Thorogood Road Dagsboro, DE: On or about February 1, 2023, the compliance officer observed that the host employer did not ensure that his contract employer, developed an energy control program to be followed [e.g. confine space program] in order to control hazardous energy for his contracted employees attempting to engaged in maintenance within the confine space of the sand bin. It was determined that while employees were within the sand bin, the hatch at the base of the bin open, engulfing a contract employee who was later hospitalized. NOTE: The procedure must contain information which authorized employees must know to safely control hazardous energy. Over generalization can result in a document which has little or no utility to the employee who must follow procedure. However, while the procedure is required to be written in detail, this does not mean that a separate procedure must be written for each and every machine or piece of equipment. Similar machines and/or equipment (those using the same type and magnitude energy) that has the same or similar types of controls can be covered with a single procedure.
