29 CFR  1910.119(d)(3)(ii): The employer did not document that equipment complies with recognized and generally accepted good engineering practices.  On or about January 30, 2023, employees were exposed to fire, explosion and toxic gas release hazards when the employer did not document that equipment, including the pressure relief systems complied with the employer's chosen RAGAGEP such as but not limited to ASME Boiler and Pressure Vessel Code, Section VIII Division 1, Part UG-134(e) when there were block valves in the relief paths and they were not positively secured in the opened position; including but not limited to block valves on the vapor vent line of the Knock Out Drum  (PV-1522).

29 CFR  1910.119(e)(5): The employer did not establish a system to promptly address the team's findings and recommendations; assure that the recommendations are resolved in a timely manner and that the resolution is documented; document what actions are to be taken; complete actions as soon as possible; develop a written schedule of when these actions are to be completed; communicate the actions to operating, maintenance and other employees whose work assignments are in the process and who may be affected by the recommendations or actions.   On or about January 30, 2023, employees were exposed to fire, explosion and toxic gas release hazards when the employer did not resolve the NHT 2020 PHA recommendations in a timely manner, including but not limited to Recommendation 8.5.1.1. Make 4" Block valve on vent line between PV-1522 and PV-0603 Car Sealed Open (CSO) to prevent overpressure in PV-1522.

29 CFR  1910.119(d)(3)(i)(B): Piping and instrument diagrams (P&ID's);   On or about January 30, 2023, employees were exposed to fire, explosion and toxic gas release hazards when the employer did not ensure the Piping and Instrument Diagrams (P&ID) were updated to reflect the equipment including but not limited to;  Instance a) In  NHT, car seals were not shown on P&ID E-06A-0633 for 10" valves on inlet piping of PV-0604 and PV-0605.     Instance b) In 1st Stage HCU process area, pressure gauge was installed instead of plug on ?" bleeder valve as shown in P&ID E-16A-0196.
