29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a. On or about February 09, 2023, at 6300 Hoover Boulevard, Tampa, Florida, the employer failed to instruct employees working in an excavation in the recognition and avoidance of unsafe conditions, wherein daily safety inspections of the excavation, the adjacent areas, means of egress and protective systems were not made by a competent person, and during which time a cave-in protective system was not in use; therefore exposing the employees to cave-in/caught between hazards.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:  a. On or about February 09, 2023, at 6300 Hoover Boulevard, Tampa, Florida,  employee were working in an excavation found to have been dug into type C soil, to a depth of 8.87 feet, for which the adjacent areas, means of egress and protective systems were not inspected by a competent person for evidence of a situation that could have resulted in possible cave-ins and/or indications of failure of protective systems; wherein the excavation in question contained safety deficiencies such as but not limited to, having contained standing water, and was not sloped, shielded or shored to prevent cave-in; therefore exposing the employees to cave-in/caught between hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  a. On or about February 09, 2023, at 6300 Hoover Boulevard, Tampa, Florida,  employee were working in an excavation found to have been dug into type C soil, to a depth of 8.87 feet, which was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c), nor had the employer complied with the provisions of 29 CFR 1926.652(b)(1)(i), in that the excavation which contained standing water, and was not sloped, shielded or shored to prevent cave-in; therefore exposing the employees to cave-in/caught between hazards.
