OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by/caught between hazards from not utilizing a powered industrial truck operator protection device or system:  a) On or about February 4, 2023 employees operating a Caterpillar powered industrial truck Model TL943C were not utilizing the truck's seatbelt, exposing them to struck-by and crushed by hazards.
