29 CFR 1926.20(b)(2):  The employer did not ensure for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers:  (a)PM Contracting LLC at 1522 Sweet Grass Drive, Brookings SD 57006: On or about and at times prior to February 10, 2023, the exposing employer did not ensure that frequent and regular inspections were conducted by a competent person. This condition exposed employees to various hazards such as fall hazards, forklift hazards, lack of Personal Protective Equipment (PPE), and lack of training.

29 CFR  1926.102 (a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying objects while using a pneumatic nail gun:  (a) PM Contracting LLC at 1522 Sweet Grass Drive, Brookings SD 57006: On or about and at times prior to February 10, 2023, the exposing employer did not ensure that employees were using eye protection while using the pneumatic nail gun while conducting framing operations on a residential property.  This condition exposed employees to eye injuries including the introduction of foreign particles into the eye while working.

29 CFR  1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:  (a)PM Contracting LLC at 1522 Sweet Grass Drive, Brookings SD 57006: On or about and at times prior to February 10, 2023, the exposing employer did not ensure that the elevated platform was properly attached to the Genie GTH-1056 All-Terrain Forklift, in that, no safety pins were installed to ensure the security of the basket to the mast. This condition exposed employees to fall hazards and crushing hazards associated with the platform separating from the mast of the forklift.
