29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: guardrail systems, safety net systems, or personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems:  (Instance A)  On or before February 12, 2023, employees used the mezzanine located in Building 1 to gather supplies/parts. The mezzanine had an unprotected side, to its left, where the edge was approximately 9 feet, 7 inches above the lower level.   (Instance B)  On or before February 12, 2023, employees used the mezzanine located in Building 2 to store parts and materials. The mezzanine has an unprotected edge to the right of its entrance approximately 8 feet, 4 inches above the lower level.

29 CFR  1910.29(b)(1):The top edge height of top rails, or equivalent guardrail system members, were not  42 inches (107 cm), plus or minus 3 inches (8 cm), above the walkingworking surface; where the top edge height exceeded 45 inches (114 cm), the guardrail system did not meet all other criteria of paragraph (b) of this section (see Figure D-11 of this section).  On or before February 15, 2023, employees were using the mezzanine to gather supplies/parts while the mezzanine had an open unprotected side, the unprotected side had metal wire strung acting as a fall protection but was not  42 inches, plus or minus 3 inches, above the surface.
