29 CFR 1910.242(a): General requirements. Each employer shall be responsible for the safe condition of tools and equipment used by employees, including tools and equipment which may be furnished by employees. a) On February 21, 2023, the employer did not ensure that the condition of personal tools, such as the jack stands, and other equipment being furnished and used by employees on location was safe in that the two ton unmarked silver jack stand used by employees were not determined to be safe for jobs including upholding the New Holland Hayliner 275 Plus, weighing approximately 3,940 pounds.

29 CFR 1910.244(a)(1)(ii): Jacks. Loading and marking. The operator shall make sure that the jack used has a rating sufficient to lift and sustain the load. The rated load shall be legibly and permanently marked in a prominent location on the jack by casting, stamping, or other suitable means. a) On February 21, 2023, the employer did not ensure that the employee owned jack stands being used to lift the New Holland Hayliner 275 Plus, weighing approximately 3,940 pounds, were legibly marked with the rating of the jack stands prior to supporting the load.
