29 CFR  1910.23(b)(8):  The employer did not ensure that ladders are used only for the purposes for which they were designed:  On or about March 1, 2023, employees were exposed to fall hazards of seven feet ten inches to a lower level when working near Shelf 9 located in Warehouse A and the employer permitted employees to stand on and climb through the mobile ladder stand guardrail system to access an upper level loft area.

29 CFR  1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):   On or about March 1, 2023, employees were exposed to fall hazards of seven feet ten inches to a lower level when walking-working near an open edge located on the loft above Shelf 9 in Warehouse A  and the employer had not ensured a suitable fall protection system was used.

29 CFR  1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:   On or about March 1, 2023, employees were exposed to hazards when forklift attachments, which affected the capacity and/or safe operation of the Caterpillar TC40D forklift, were used and the employer had not obtained written manufacturer approval for the additions in the following instances:  a. Forklift extensions,  which exceeded 150% of the fork length, were attached to forks to lift and stack wooden containers.  b. An elevating platform was attached to forks and used to elevate personnel to access loft area eight feet above a lower level.
