29 CFR  1926.1153(c)(1):For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  (a) Loera's Landscaping LLC, 1277 Santa Fe Drive, Denver, CO 80204: On or about March 1, 2023, and at times prior, employees were exposed to airborne crystalline silica while cutting landscaping bricks with a concrete disk cutting saw that was not equipped with integrated water delivery system that continuously feeds water to the blade.  (b) Loera's Landscaping LLC, 1277 Santa Fe Drive, Denver, CO 80204: On or about March 1, 2023, and at times prior, employees were exposed to airborne crystalline silica while cutting landscaping bricks with a concrete disk cutting saw for more than 4 hours without the use of respiratory protection at APF 10.

29 CFR  1926.1153(d)(1): The employer did not ensure that employees were not exposed to an airborne concentration of respirable crystalline silica in excess of 50 ug/m3, calculated as an 8-hour TWA:   (a) Loera's Landscaping LLC, 1277 Santa Fe Drive, Denver, CO 80204: On or about March 1, 2023, and at times prior, employees were exposed to unknown concentrations of airborne respirable crystalline silica while cutting landscaping bricks for an entire shift without engineering or PPE controls.

29 CFR  1926.1153(f)(1):The employer allowed dry sweeping or dry brushing where such activity could contribute to employee exposure to respirable crystalline silica and wet sweeping, HEPA-filtered vacuuming or other methods were feasible:  (a) Loera's Landscaping LLC, 1277 Santa Fe Drive, Denver, CO 80204: On or about March 1, 2023, and at times prior, employees were exposed to airborne crystalline silica while using a shop broom to dry sweep the work area while all employees were in the direct vicinity of the airborne respirable silica.
