29 CFR 1926.102(a)(1): Employees did not use eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents: a) At The Enclave at Bakers Farm, Lot 124, 141 Amber Meadow Drive Braselton, Georgia, on or about February 27, 2023 workers performing framing operations were exposed to struck-by hazards, in that the employer did not enforce the use of protective eyewear where equipment including but not limited to circular saws and pneumatic nail guns were in use.

29 CFR 1926.304(d): Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe: a) At The Enclave at Bakers Farm, Lot 124, 141 Amber Meadow Drive Braselton, Georgia, on or about February 27, 2023, the employer exposed employees to severe laceration/amputation hazards while operating a circular saw, in that the lower guard was made inoperable as a wood shim was placed between the upper and lower guards which prevented the guard from retracting after a cut was made.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) At The Enclave at Bakers Farm, Lot 124, 141 Amber Meadow Drive Braselton, Georgia, on or about February 27, 2023 workers performing framing operations on the 8/12 pitched roof were observed exposed to fall hazards up to approximately 33-feet from the eaves to the lower level, in that the employer did not enforce the use of personal fall protection.
