29 CFR 1910.30(a)(1): (a) Fall hazards. (1) Before any employee is exposed to a fall hazard, the employer must provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart. Employers must ensure employees are trained in the requirements of this paragraph on or before May 17, 2017. a. On or about February 28, 2023, at the above addressed jobsite, employees performing banner maintenance activities from a Genie Z-40/23N were not provided training on how to minimize fall hazards, thereby exposing employees to the hazards associated with falls.

29 CFR 1910.67(c)(2)(v): (v) A personal fall arrest or travel restraint system that meets the requirements in 29 CFR part 1910, subpart I, was not worn and attached to the boom or basket when working from an aerial lift. a. On or about February 28, 2023, at the above addressed jobsite, employees performing banner maintenance activities from a Genie Z-40/23N were not wearing a body belt or full body harness. The employees were thereby exposed to the hazards associated with a fall of approximately sixteen (16') feet.
