29 CFR  1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:   (a)Jarding Construction Inc. at 5400 and 5402 West Cardinal Cove Place, Sioux Falls, SD 57106:  On or about and at times prior to March 8, 2023, the employer did not ensure that a safety program which provided for frequent and regular inspections was implemented. This condition exposed employees to fall hazards and  ladder hazards.

29 CFR  1926.501(b)(13): Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected from falling by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a)Jarding Construction Inc.  at 5400 and 5402 West Cardinal Cove Place, Sioux Falls, SD 57106 on or about and at times prior to March 8, 2023,  the controlling employer did not ensure that subcontracted employees were protected from falls greater than six feet  during framing operations with no protective system in place.  This condition exposed the employees to a fall hazard greater than six feet.
