29 CFR  1910.95(c)(1): A continuing, effective Hearing Conservation program as described in 29 CFR 1910.95(c) through (n) was not instituted when employee noise exposures equaled or exceeded an 8-hour Time-Weighted Average sound level (TWA) of 85 decibels (dBA).  An effective hearing conservation program which included noise monitoring, audiometric testing and training of employees as detailed in the standard was not instituted by Chicago Pallet Service II, Inc.  a) An employee operating the woodpecker #2 machine was exposed to continuous noise levels at 177.4% of the allowable 8-hour time-weighted average sound level (85 dBA). The equivalent dBA level of 177.4% is approximately 91.21 dBA. The sampling was performed for 479 min during one 8-hour shift on March 17, 2023. Zero exposure was assumed for the unsampled period of time, 1 minute.    b) An employee operating the woodpecker #3 machine was exposed to continuous noise levels at 110.1% of the allowable 8-hour time-weighted average sound level (85 dBA). The equivalent dBA level of 110.1% is approximately 87.39 dBA. The sampling was performed for 475 min during one 8-hour shift on March 17, 2023. Zero exposure was assumed for the unsampled period of time, 5 minutes.    c) An employee operating the five head saw was exposed to continuous noise levels at  102.8% of the allowable 8-hour time-weighted average sound level (85 dBA). The equivalent dBA level of 102.8% is approximately 87 dBA. The sampling was performed for 461 minutes during one 8-hour shift on March 17,2023. Zero exposure was assumed for the unsampled period of time, 19 minutes.  d) An employee performing manual pallet assembly was exposed to continuous noise levels at 188.8% of the allowable 8-hour time-weighted average sound level (85 dBA). The equivalent dBA level of 188.8% is approximately 92.58 dBA. The sampling was performed for 463 min during one 8-hour shift on March 17, 2023. Zero exposure was assumed for the unsampled period of time, 17 minutes.    e) An employee performing manual pallet assembly was exposed to continuous noise levels at 207.3% of the allowable 8-hour time-weighted average sound level (85 dBA). The equivalent dBA level of 207.3% is approximately 92.55 dBA. The sampling was performed for 449 min during one 8-hour shift on March 23, 2023. Zero exposure was assumed for the unsampled period of time, 31 minutes.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
