29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: (a) 23 Washington Ave, Golden, CO 80403: On or about March 15, 2023, and at times prior, the employer did not provide protection from spoils piles and excavated materials by placing them at least 2 feet from the edge of excavations, or by the use of retaining devices. Employees were exposed to hazards from falling materials when in the excavation to conduct work including but not limited to taking measurements and marking grade in the excavation.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a) 23 Washington Ave, Golden, CO 80403: On or about March 15, 2023, and at times prior, the employer did not provide a protective system to protect employees from cave-in hazards while working in an excavation in excess of 7.5 feet deep. Employees were exposed to cave-in hazards when measuring and marking elevation in the excavation. Walls of the excavation were not sloped or benched adequately, and no shoring or shielding was provided for use.
