1910.134(c)(2)(i) An employer may provide respirators at the request of employees or permit employees to use their own respirators, if the employer determines that such respirator use will not in itself create a hazard. If the employer determines that any voluntary respirator use is permissible, the employer shall provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard"); and On or about April 19, 2023, the employer did not provide medical evaluations to employees working in the Fish DC required to wear respiratory protection, including filtering facepiece 3M N95 Particulate Respirator (8210) exposing them to potential health hazards and respiratory illnesses. 29 CFR 1910.303(f)(2): Services, feeders, and branch circuits. Each service, feeder, and branch circuit, at its disconnecting means or overcurrent device, shall be legibly marked to indicate its purpose, unless located and arranged so the purpose is evident. On or about March 16, 2023, the employer did not ensure each branch circuit, at its disconnecting means or overcurrent device, was legibly marked or identified within electrical panels. The following instances were observed: (a) Circuits inside 120/208 V Panel RPP-1A had multiple circuits within that were not labeled. (b) Circuits inside 120/208 V Panel RPP-1B had multiple circuits within that were not labeled. (c) A 120/208 V electrical panel in the Fish DC next to Panel P-3 was not labeled and the circuits within were not labeled. . Employees are not able to identify energy source(s) while performing lock out tag out, exposing them to electrical shock hazards and injuries. Corrected during inspection.

29 CFR 1910.1200(f)(6): Workplace labeling. The employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked as required. On or about March 16, 2023, the employer did not ensure that each container of hazardous chemicals was labeled, tagged, or marked as required. There were multiple bottles that appeared to have been purchased with the original contents and then repurposed when empty for fill, mix, and transfer of unknown chemicals: (a) In the Fish DC, inside the Hazardous Chemicals storage room, there were 4 bottles that were originally Formacide-B and repurposed for a mixture of water and Malachite Green. These bottles were not properly labeled. (b) In the Fish DC, inside the Hazardous Chemicals storage room, there was a solid white spray bottle that was not properly labeled. (c) In the Fish DC, behind the large white tanks, there was a tote (appearance similar to a 5-gallon jug) sitting on top of a bucket turned upside down. The tote was filled with a green liquid, and the area surrounding the bucket was covered in what appeared to be the same green liquid that had partially solidified like a sludge or slime. The tote was not labeled. Employees are exposed to injury and illness such as chemical burns and respiratory hazards from unknown chemical exposure. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.1200(g)(1): Chemical manufacturers and importers shall obtain or develop a safety data sheet for each hazardous chemical they produce or import. Employers shall have a safety data sheet in the workplace for each hazardous chemical which they use. On or about March 16, 2023, Fish DC Employees did not have access to the safety data sheets in the workplace for each hazardous chemical which they use. Employees are exposed to injury and illness such as chemical burns and respiratory hazards from unknown chemical exposure. Corrected during inspection.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets. On or about June 29, 2023, the employer did not provide employees working in the Fish DC with effective information and training on hazardous chemicals. Employees were working with chemicals such as Formalin-B and Malachite Green and did not know the potential hazards associated with exposure to these chemicals as well as others they worked with daily. Employees are exposed to injury and illness such as, but not limited to, chemical burns, organ tissue damage, and respiratory hazards while working with the chemicals in the Fish DC with no training on the hazards associated with each chemical and did not know what to do in the event of an exposure. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
