29 CFR  1910.178(q)(1):Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel:  a.) 5340 Panola Industrial Blvd. Decatur, Georgia, 30035; On or about March 16, 2023 and at times prior, on the production floor,  the employer exposed employees to struck by hazards in that the employer permitted employees to operate a forklift (Hyster) whose horn was not in safe operating conditions and failed to take the forklift out of service or perform repairs.

29 CFR  1910.132(d)(2):The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.  a.) 5340 Panola Industrial Blvd. Decatur, Georgia 30035; On or about March 16, 2023 and at times prior, the employer had assessed the workplace for some hazards but had not addressed all nor verified the assessment had been performed through a written certification. The employer also did not require any PPE to be worn throughout the facility when employees were exposed to hazards, including but not limited to, lacerations from the cutting saw.

The emergency exit door hardware was not maintained in good repair resulting in damage of the push bar handle with failure to open door during an emergency.
