29 CFR  1917.95(b)(1):The employer did not provide and direct the wearing of personal flotation devices for those employees engaged in work in which they may be pulled into the water.  a) 1 Hausel Road Berth #3 Wilmington, De. 19801: On or about, November 4, 2022, the employer did not ensure that employee assiting with fueling activities while moored at berth, failed to ensure that employee were wearing a personal flotation device (PFD) while working near the waters edge.  This condition exposed employees to a fall/drown hazard.
